The principle of absolute liability and the importance of valid car insurance

The principle of absolute liability

The Compensation for Road Accident Victims Law, 1975, stipulates that every person injured in an accident is entitled to compensation for the physical damages caused to him in a car accident, regardless of the question of guilt. That is, even if the injured driver caused the accident and it is his fault, he will be entitled to compensation. This principle is in fact contrary to the basic rule in the world of torts, in the framework of which it is usually necessary to prove the liability of the offender, in order to receive monetary compensation. However, with regard to car accidents, the legislature has decided that entitlement to compensation is absolute and stands for every person injured in a car accident. However, the eligibility of the injured party in a road accident, for compensation without having to prove guilt, has a condition that the vehicle was insured with compulsory insurance at the time of the accident.

What does the financial compensation consist of?

There are various damages which the victim of a road accident can claim, depending on the circumstances of the case, among them, loss of earnings due to loss of ability to work, reimbursement of medical expenses incurred by the victim as well as future medical expenses due to permanent disability. The injured party will be able to receive monetary compensation for the cost of third-party assistance, insofar as he needs or will need the help of others in carrying out daily activities, etc. All of these are financial compensation that can be relatively easily quantified into a monetary amount. That is, he is not required to prove the other party’s liability for the accident in order to receive monetary compensation and he will even be entitled to it even if he himself is guilty of it. It is important to note that bodily harm includes both physical and mental harm. The compensation is paid by the insurance company which insured the vehicle with a compulsory insurance policy. Therefore, the driver will only be able to receive such compensation if he had valid compulsory insurance at the time of the accident. If the driver was driving at the time of the accident without a valid compulsory insurance policy, he will be required to prove the other driver’s liability in the accident and only then will he be able to receive monetary compensation. That is, without compulsory insurance, the principle of absolute liability that provides compensation without the question of guilt under the Law, does not apply. The injured driver will therefore be required to file an ordinary tort claim under the Torts Ordinance, and prove the liability of the other driver, and if he does not meet the burden of proof, he will not be able to receive compensation.
